EMPHASIS: Shooting Incident In Bates County

On June 30, 2009, at approximately 3:30 p.m., officers from the Bates County Sheriff’s Department and members of the Missouri State Highway Patrol attempted to serve a search warrant at a residence on County Road 4501 in Bates County. Officers had an arrest warrant for an occupant of the residence. Douglas S. Miller, 45, was wanted on a five count felony warrant out of Pasco County, Florida, and a felony warrant out of Cook County, Illinois. Upon announcing their presence and making entry into the residence officers were fired upon by a subject in the residence. Officers returned fire and the subject retreated to a back room in the residence.
During the exchange of gunfire, a member of the Missouri State Highway Patrol was shot in the tactical vest and sustained minor injuries. The trooper was treated at the scene by paramedics and released. Officers attempted to negotiate with the subject and were unsuccessful. Officers exited the residence and set up a perimeter around the residence.
Members of the Highway Patrol’s Special Weapons and Tactics Team (SWAT), and the Cass County Sheriff’s Department tactical team responded to the residence. Attempts to make contact with the subject by the Highway Patrol negotiator were unsuccessful. At approximately 8:30 p.m., a pole camera was inserted through a window into the room where the subject was thought to be. Officers observed a subject slumped over onto the floor. Members of the tactical team entered the residence and discovered the body of a white male, who was deceased. Members from the Highway Patrol’s Division of Drug and Crime Control are investigating the shooting incident.
The autopsy of the deceased is scheduled for sometime Thursday, July 2, 2009, at the Jackson County Medical Examiner’s Office. Cause of death will not be released until the autopsy is completed. The identity of the deceased will not be released until positive identification has been made and next of kin has been notified.
In a related matter to this incident, Nicki Lynn, 53, of Adrian, Missouri, was arrested on June 30, 2009, at 10:00 p.m., at the same residence on County Road 4501. Lynn was arrested by a member of the Missouri State Highway Patrol for hindering prosecution of a felon, and transported to the Bates County Jail.
The charge for which Nicki Lynn was arrested is a mere accusation and is not evidence of guilt. Evidence in support of the charge must be presented before a court of competent jurisdiction whose duty is to determine guilt or innocence.
