EMPHASIS: Felony Marijuana Arrest In Boone County


On October 23, 2008, the Missouri State Highway Patrol Troop F Eradication Team arrested two individuals at a residence in Columbia, MO. A subsequent search of the residence revealed an indoor growing operation with approximately 106 live marijuana plants. A small amount of packaged marijuana, drug paraphernalia and $2,400 of U.S. currency was also seized. Arrested was Joshua J. Pemberton, 29, of Columbia, MO, and Sarah E. Herling, 23, of Columbia, MO. They were taken to the Boone County Jail where bond was set for Pemberton at $20,000 and $10,000 for Herling.
Pemberton and Herling were arrested after troopers conducted an investigation that led to the location of the growing operation inside the Pemberton residence. They were arrested for felony possession of marijuana with intent to distribute and the manufacturing of a controlled substance.
The charges for which Pemberton and Herling were arrested are mere accusations and are not evidence of guilt. Evidence in support of these charges must be presented before a court of competent jurisdiction, whose duty is to determine guilt or innocence.
