On February 24, 2003, several Missouri State Highway Patrol troopers and Kansas City police officers conducted a saturation patrol in the northland area where two troopers were shot at during a pursuit on February 17, 2002. One of the troopers observed a pickup truck matching the description of the truck driven by the suspects involved in the shooting. The driver of the truck was contacted by the trooper. During the contact damage was observed on the truck that was consistent with damage received by the truck involved in the earlier pursuit. The driver was identified as Ariel Lugo, 18, of Kansas City, Missouri. He was arrested without incident. Further investigation revealed the location of the second suspect involved in the shooting. Marvin D. Russ, 34, of Kansas City, Kansas, was arrested without incident by the Kansas City, Missouri Police Department.
Both suspects were arrested for First Degree Assault of a Police Officer. Mr. Lugo is being held on a Platte County warrant for First Degree Assault of a Police Officer. Mr. Russ is being held as a fugitive out of state stemming from a warrant in Arkansas. The truck has been seized as evidence and will be processed. The investigation is continuing.
The charges for which the individuals were arrested are mere accusation and are not evidence of guilt. Evidence in support of the charges must be presented before a court of competent jurisdiction, whose duty is to determine guilt or innocence.
