On December 20, 2007, at approximately 7:30 p.m., a member of the Missouri State Highway Patrol stopped a 2002 Chevrolet Avalanche pickup on Interstate 35 at the 58-mile marker for a traffic violation. The trooper noticed an odor of marijuana. Consent to search the vehicle was obtained and 180 pounds of marijuana was located in the cargo area of the pickup.
The driver, Michael A. Ervin, 39, of Kansas City, Missouri, was arrested for trafficking drugs second degree, and taken to the Daviess/DeKalb County Regional Jail in Pattonsburg, Missouri.
The charge for which Michael A. Ervin was arrested is a mere accusation and is not evidence of guilt. Evidence in support of the charge must be presented before a court of competent jurisdiction whose duty it is to determine guilt or innocence.
