EMPHASIS:
Lowry City Man Arrested Following Officer-Involved Shooting
On Wednesday, August 7, 2019, Shane M. Magoon, 47, of Lowry City, Missouri, was arrested on a St. Clair County, Missouri, felony warrant for the following charges: unlawful use of a weapon, armed criminal action, unlawful possession of a firearm, resisting arrest/detention/stop by fleeing, and assault - fourth degree. The charges stem from a pursuit on June 9, 2019, which resulted in an officer-involved shooting.
On June 9, 2019, a St. Clair County deputy attempted to stop a motorcycle operated by Magoon for a traffic violation on Missouri Route A. Magoon failed to yield to the emergency vehicle for approximately two miles and then stopped. According to the deputy, once stopped, Magoon began verbally taunting the deputy and threatened to draw a 9mm handgun which was holstered on his side. The deputy deployed an electrical conductive weapon, which failed to incapacitate Magoon. Magoon then reached toward his weapon. Fearing Magoon was going to attempt to shoot him, the St. Clair County deputy fired his duty weapon one time, striking Magoon.
Upon request by the St. Clair Sheriff’s Department, the Missouri State Highway Patrol’s Division of Drug and Crime Control investigated the officer-involved shooting. Based upon the investigation, the St. Clair Prosecuting Attorney issued an arrest warrant for Magoon on August 7, 2019.
The charges for which Magoon were arrested are mere accusation and are not evidence of guilt. Evidence in support of the charges must be presented before a court of competent jurisdiction whose duty is to determine guilt or innocence.
