EMPHASIS: Traffic Stop On Interstate 55 Results In Drug Arrest

On September 8, 2007, at approximately 8:55 p.m. a member of the Missouri State Highway Patrol stopped a 2007 Ford Focus traveling north on Interstate 55 in Pemiscot County for a traffic violation.
During the course of the traffic stop, consent to search was requested. After receiving consent to search, the trooper discovered two pounds of marijuana in the truck as well as a stolen pistol. The driver, Kelvin B. Durham, 44, and a passenger, William M. Young, 45, of St. Louis, Missouri, were arrested for possession of a controlled substance with intent to distribute and possession of stolen property, and taken to the Pemiscot County Jail.
The charges for which Kelvin B. Durham and William M. Young were arrested are mere accusation and not evidence of guilt. Evidence in support of the charges must be presented before a court of competent jurisdiction whose duty is to determine guilt or innocence.
